1. Parties and Acceptance
This Curator Data Protection and Enquiry Handling Schedule applies between MYRA MULTIMEDIA ENTERPRISE PRIVATE LIMITED (Skibbo) and the Curator identified in the signed or electronically accepted Curator Registration Agreement. It becomes binding only when properly incorporated into and accepted with that agreement. This schedule is not a substitute for the full Curator Agreement.
2. Purpose and Information Shared
For each valid enquiry, Skibbo may automatically disclose the Explorer’s name (where collected), mobile number and relevant enquiry details to the selected Curator, while sending Curator contact information to the Explorer. Skibbo retains administrative visibility. The Curator may use Explorer information solely to respond to, arrange and deliver the relevant experience and associated lawful support, except where a separate lawful permission applies.
3. Prohibited Uses
The Curator must not sell or trade enquiries, disclose contact details publicly, share them with unrelated parties, use them for unrelated promotions without appropriate authorisation, impersonate Skibbo, scrape platform data, or use the information for harassment, fraud or unlawful discrimination.
4. Confidentiality and Safeguards
The Curator must limit access to personnel with a legitimate need, maintain reasonable security controls, use appropriate communication channels and ensure authorised assistants or service providers observe equivalent confidentiality and security duties. The Curator remains responsible for its own personnel and subcontractors.
5. Independent Processing and Compliance
Each party is responsible for its own acts and omissions and for the privacy obligations applicable to its role. The Curator must provide any additional notices or obtain permissions required for subsequent independent uses and must comply with applicable law. No contractual disclaimer removes Skibbo’s non-excludable responsibilities.
6. Incident Reporting and Cooperation
The Curator must notify Skibbo without undue delay and, where practicable, within 24 hours of becoming aware of suspected or actual loss, unauthorised access, disclosure or misuse involving Skibbo-generated enquiry information, describing known facts and containment steps. The Curator must preserve evidence, mitigate harm, cooperate with investigation and statutory notifications, and not make misleading statements about the incident.
7. Requests, Retention and Deletion
The Curator must handle valid privacy requests lawfully, reasonably cooperate with Skibbo on enquiries concerning shared information, and delete or securely de-identify lead information when no longer needed for the relevant purpose unless lawful retention is required. On termination or Skibbo’s reasonable written request, the Curator must delete or return data subject to lawful exceptions and confirm compliance where reasonably requested.
8. Off-Platform Communications and Arrangements
Users and Curators may communicate and contract directly after an introduction. The Curator is responsible for its independent representations, payments, fulfilment, refunds and handling of information in those dealings. Skibbo remains responsible for obligations it expressly assumes and duties imposed by law.
9. Claims, Remedies and Indemnity
To the extent permitted by law, the Curator indemnifies Skibbo for substantiated third-party claims, reasonable external legal defence costs and losses directly caused by the Curator’s unlawful data processing, unauthorised disclosure, material breach of this Schedule or infringement of rights. Liability is reduced to the extent caused by Skibbo’s own fault or breach. The Curator shall cooperate reasonably in claims defence, and no settlement imposing admissions or non-monetary obligations on the other party may be made without consultation.
10. Enforcement and Priority
Skibbo may suspend lead sharing or listings where reasonably necessary to address suspected material misuse, safety or legal risks. This Schedule supplements the Curator Registration Agreement. In a conflict, an expressly negotiated data-protection provision in the signed agreement takes precedence, subject to applicable law.
11. Acceptance Record
Curator legal name: [COMPLETE IN CURATOR AGREEMENT]. Effective date: [COMPLETE]. Acceptance method and timestamp: [RECORD IN SIGNED OR ELECTRONIC CONTRACT]. Skibbo authorised representative: [IF REQUIRED].
